Section 338 duties enter tenth day with sulfur still off both lists

Ottawa retaliation is eight days out on September 8. Revised counter-tariff list counts 629 items after seafood removal.

The US 50 percent additional tariff on selected Canadian goods remained in force on August 31, the tenth calendar day after the August 22 effective time.

Prime Minister Carney's dollar-for-dollar retaliation is now eight days away, scheduled for 12:01 a.m. September 8.

Finance Minister Francois-Philippe Champagne published the counter-tariff schedule on August 25 with a Canada.ca table update on August 26.

Gowling WLG's August 26 counsel note describes a revised list of 629 tariff items after fish and seafood products were removed from the original 874-item table.

Rates of 15, 25, or 50 percent still match corresponding US Section 338 and Section 232 lines on roughly C$27.6 billion of US-origin imports.

Steel and aluminum products remain at 50 percent, doubling prior 25 percent surtaxes. Dairy, appliances, pulp and paper, electronics, furniture, and clothing stay in scope.

Nine new tariff items covering wood charcoal, printed matter, gypsum board, glass containers, and copper wire entered at the 50 percent rate in the revised list.

Goods already in transit to Canada on the effective date are exempt, a screening detail importers are working through ahead of the September calendar.

US Customs and Border Protection issued CSMS 69606660 on August 21 with implementing instructions for Section 338 duties on entries filed on or after August 22.

Elemental sulfur, HS 2503, remains absent from both the US covered lists and Canada's published September 8 retaliation table.

Energy, potash, fish, and critical minerals also stay outside the exchange on open reporting, though fish and seafood are removed from Canada's retaliation side rather than the US tariff side.

Canada remains the dominant US import source for recovered sulfur per USGS import-source tables, so a tariff-free HS 2503 lane keeps the cross-border molten and solid corridor commercially open.

Pacific loadings have been the swing-supplier answer while Middle East seaborne stays impaired. Alberta forming plants and British Columbia terminals face no new duty layer on sulfur even as steel and appliances enter the retaliation cycle.

Desk read: no change to sulfur duty treatment on either border on August 31. The eight-day countdown to Ottawa's published retaliation lines is the calendar item; HS 2503 remains off both schedules.
